Welcome to Vix Kurtis Coaching (a trading name of Vix Brand; “we,” “us,” or “our”). By accessing or using vixkurtiscoaching.com (the “Site”) or engaging in our coaching services, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Services & Coaching Disclaimer

1.1 Coaching is a non-therapeutic process intended for clients who wish to enhance their performance or improve a challenging area within work or personal life. Coaching is not therapy, counselling, consultation or medical advice. The process does not involve diagnosing, treating, or managing mental health conditions. If at any point it feels like therapeutic support would be more appropriate for the client, the Coach will gently let you know and, where possible, help you find the right resources.

1.2 Scope of Services: We provide personal growth and professional development coaching, goal setting, accountability, and educational materials.

1.3 Emergency Situations:If you are experiencing a mental health crisis or emergency, be sure to get in touch with local emergency services or a qualified medical professional immediately.

2. Bookings, Payments, & Cancellations

2.1 Fees.

All fees for coaching sessions, packages, and digital resources are listed on our Site in GBP (£) and are subject to change.

2.2 Payment Terms.

Payment must be made in full before your session or upon purchasing a package via our accepted online payment processors. Custom instalment plans are available by mutual agreement before commencing services.

2.3 Rescheduling & Cancellation Policy.

If you need to reschedule a session, please give at least 24 hours’ notice. If a session is cancelled or rescheduled with less than 24 hours’ notice without a mutually agreed reason, the full session fee may be charged or forfeited.

2.4 Technical Issues Protocol.

In the event of a technical issue (such as a lost internet connection during an online session), we can switch to a WhatsApp call or phone call. The coach will attempt to reconnect first. If the connection cannot be restored within 10 minutes, the session will be rescheduled at no additional cost.

2.5 Refund & Termination Policy.

Either party may choose to end the coaching relationship at any time. If sessions have been paid in advance and the coaching relationship is terminated early, any unused sessions will be refunded in full.

3. Client Responsibilities & Guarantees

3.1 Commitment & Engagement.

Coaching outcomes depend on your commitment, active participation, and implementation of agreed-upon actions.

3.2 No Guarantee of Specific Results.

While we provide guidance and tools, we make no guarantees regarding specific outcomes or personal results.

4. Website Use & Intellectual Property

4.1 Acceptable Use.

You agree to use the Site only for lawful purposes. You must not use the Site to submit misleading information, attempt unauthorised access, or distribute harmful code.

4.2 Ownership of Materials.

All content on this Site, including worksheets, text, graphics, logos, and digital downloads, is the intellectual property of Vix Kurtis Coaching.

4.3 Limited License.

Materials provided to you are for your personal, non-commercial use only. You may not reproduce, distribute, or sell any materials without our prior written consent.

5. Confidentiality, Generative AI & Data Protection

5.1 Confidentiality.

Everything you share in our sessions is held in complete confidence. We will not disclose any information about you or our work together to any third party without your explicit consent, with the following exceptions:

5.1a If we believe there is a serious and immediate risk to your safety or the safety of others;

5.1b If required to disclose information by law;

5.1c Anonymised details discussed with a coaching supervisor as part of professional practice (your identity will never be disclosed).

5.2 Generative AI Policy.

We will not record or film any sessions. We will not upload any session recordings, footage, or notes to generative AI software, nor do we use AI note-taking software during sessions.

5.3 Data Protection & Privacy.

Personal data (name, contact details, session notes) is stored securely in accordance with UK GDPR and the Data Protection Act 2018. Session notes are stored securely using encrypted applications or secure physical storage and retained for up to 7 years in line with Association for Coaching recommendations. Your use of our Site is also governed by our Privacy Policy.

6. Limitation of Liability

6.1 To the maximum extent permitted by applicable law, Vix Kurtis Coaching / Vix Brand shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or coaching services.

6.2 Our total liability for any claim related to our services shall not exceed the total amount paid by you to us in the 6 months preceding the claim.

7. Governing Law & Dispute Resolution

7.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

7.2 Any dispute arising from these Terms or our services shall first be attempted to be resolved informally through good-faith negotiation.

8. Changes to Terms & Contact Information

8.1 We reserve the right to modify these Terms at any time. Updated versions will be posted on this page with an updated "Last Updated" date.
